These Terms of Use (“Terms”) govern your access to and use of:

  • pestify.gr (marketing website), and
  • app.pestify.gr and related mobile applications (the “Platform”),

operated by:

Pest – Free

Greece

By accessing or using Pestify, you agree to be bound by these Terms.

If you do not agree, you must not use the services.

1. Scope of the Services

Pestify is a digital software platform designed for pest control businesses to:

  • Manage customer data
  • Organize service schedules
  • Maintain service logs and documentation
  • Generate structured compliance reports
  • Improve operational workflows

The marketing website (pestify.gr) is informational only and does not provide pest control services.

2. Eligibility

The Platform is intended primarily for business users (B2B).

By using the Platform, you confirm that:

  • You are acting on behalf of a business entity, or
  • You are legally authorized to bind the business you represent

If you are a consumer within the meaning of EU consumer law, certain mandatory consumer protections may apply.

3. Account Registration

To access the Platform, you may need to create an account.

You agree to:

  • Provide accurate and complete information
  • Maintain confidentiality of login credentials
  • Be responsible for all activities under your account

You must notify us immediately of unauthorized use.

We reserve the right to suspend or terminate accounts in case of breach.

4. Subscription & Payments

If paid plans are offered:

  • Subscription fees are stated on the Pricing page.
  • Fees are exclusive of VAT unless stated otherwise.
  • Payment terms will be specified at checkout.
  • Failure to pay may result in suspension.

Free trials, if offered, convert to paid subscriptions unless cancelled before expiration.

5. Acceptable Use

You agree NOT to:

  • Use the Platform for unlawful purposes
  • Upload illegal or harmful content
  • Interfere with system security
  • Reverse engineer, copy, or exploit the software
  • Use the Platform to process data without legal basis under GDPR

You are solely responsible for the legality of the data you upload.

6. Intellectual Property

All intellectual property rights in:

  • Software
  • Code
  • Design
  • Branding
  • Documentation
  • Logos

are owned by Pest – Free unless otherwise stated.

You are granted a limited, non-exclusive, non-transferable license to use the Platform for internal business purposes only.

You may not:

  • Resell the Platform
  • Modify or redistribute it
  • Create derivative works

7. Data Protection (GDPR Roles)

7.1 Marketing Website

For pestify.gr, Pest – Free acts as Data Controller as described in the Privacy Policy.

7.2 Application Platform

When business customers upload personal data (e.g., homeowner names):

  • The pest control company is the Data Controller
  • Pestify acts as a Data Processor under Article 28 GDPR

We process data solely:

  • On documented instructions from the business customer
  • To provide the contracted service

Requests from individuals (data subjects) should primarily be directed to the business acting as Controller.

A Data Processing Agreement (DPA) may apply where required by law.

8. Availability of Service

We aim to provide continuous access but do not guarantee uninterrupted availability.

The Platform may be temporarily unavailable due to:

  • Maintenance
  • Security updates
  • Technical failures
  • Force majeure events

We reserve the right to modify or discontinue features.

9. Limitation of Liability

To the maximum extent permitted under Greek and EU law:

  • The Platform is provided “as is”.
  • We do not guarantee error-free or uninterrupted service.
  • We are not liable for indirect, incidental, or consequential damages.
  • Our total liability shall not exceed the amount paid by the customer in the preceding 12 months.

Nothing in these Terms excludes liability for:

  • Death or personal injury caused by negligence
  • Fraud or fraudulent misrepresentation
  • Any liability that cannot be excluded under applicable law

10. No Professional Advice

Pestify is a software tool.

It does not provide:

  • Legal advice
  • Regulatory advice
  • Pest control services
  • Certification guarantees

Users remain fully responsible for regulatory compliance in their jurisdiction.

11. Termination

We may suspend or terminate access if:

  • You breach these Terms
  • You fail to pay subscription fees
  • Use poses security risks
  • Required by law

You may terminate your account at any time.

Upon termination:

  • Access is revoked
  • Data may be deleted according to the Privacy Policy

12. Third-Party Services

The Platform may integrate third-party services such as:

  • Hosting providers
  • Calendly (demo booking)
  • Infrastructure services

We are not responsible for third-party policies or performance.

13. Confidentiality

Both parties agree to maintain confidentiality of non-public business information.

This obligation survives termination.

14. Force Majeure

We are not liable for failure to perform due to events beyond reasonable control, including:

  • Natural disasters
  • War
  • Government actions
  • Internet failures
  • Power outages

15. Governing Law & Jurisdiction

These Terms are governed by the laws of Greece.

Any disputes shall be subject to the exclusive jurisdiction of the courts of Greece, unless mandatory EU consumer law provides otherwise.

16. Amendments

We may update these Terms.

Updated versions will be published on this page with a revised date.

Continued use constitutes acceptance.
